Enterprise Breached Pipeline Contract, Energy Transfer Says

Oct. 3 (Bloomberg) — Enterprise Products Partners LP breached its contract when it abandoned an agreement to build a pipeline while planning to pursue a similar project with another company, Energy Transfer Partners LP said in a lawsuit.
Energy Transfer filed suit in Texas state court on Sept. 30, a day after Enterprise announced the new pipeline project with Enbridge Inc. Energy Transfer, based in Dallas, alleges breach of contract, breach of fiduciary duty and unfair competition in the lawsuit, which also accuses Enbridge of interference.
Enterprise, the biggest U.S. pipeline operator, proposed a joint venture with Energy Transfer in April to build a 400,000- barrel-a-day oil conduit from Cushing, Oklahoma, to Houston. Enterprise, based in Houston, called off the so-called Double E pipeline on Aug. 19 citing a lack of sufficient customer interest.
The company announced a partnership with Calgary-based Enbridge on Sept. 29 to build an 800,000-barrel-a-day pipeline between the two cities. That project is known as the Wrangler pipeline.
Enterprise tried to persuade Energy Transfer “to terminate the joint venture due to the new pipeline’s supposed lack of commercial viability, while simultaneously plotting to establish a new joint venture to build the same pipeline,” Energy Transfer said in its complaint.
“When Enterprise could not persuade Energy Transfer to terminate the joint venture, Enterprise simply pretended that the joint venture never existed,” according to the complaint.
‘Frivolous’ Lawsuit
The lawsuit is “frivolous” and Enterprise will seek to have it dismissed, Rick Rainey, a company spokesman, said in an e-mailed statement.
Larry Springer, a spokesman for Enbridge, said the company doesn’t comment on pending lawsuits.
The Wrangler pipeline may generate more than $100 million a year in revenue, said Daniel Spears, a portfolio manager at Swank Capital LLC, which has about $1.5 billion under management including stock in Enterprise, Energy Transfer and an Enbridge subsidiary. The project is expected to cost more than $1 billion, he said.
The Double E and Wrangler pipelines are among at least three proposals to ease a supply bottleneck at the Oklahoma storage hub. Cushing is the delivery point for West Texas Intermediate, the benchmark U.S. crude. Because of a lack of pipeline connections to Gulf Coast refineries, West Texas Intermediate trades at a discount to imported oil.
Competing Pipelines
TransCanada Corp.’s Keystone XL line from Canada to the U.S. would provide a route for Canadian oil to reach the Gulf. Magellan Midstream Partners LP announced Sept. 1 that it will reverse an existing pipeline between Houston and El Paso to ship West Texas oil to the Gulf Coast.
Energy Transfer fell $1.11, or 2.7 percent, to $39.90 at 4:15 p.m. in New York Stock Exchange composite trading. Enterprise fell 10 cents to $40.05. Enbridge fell 86 cents, or 2.6 percent, to C$32.59 on the Toronto Stock Exchange.
The lawsuit is Energy Transfer Partners LP v. Enterprise Products Partners LP, 11-12667, District Court, Dallas County, Texas (Dallas).

SAN DIEGO, Oct. 19 (UPI) — A Boeing subsidiary has been selected by the US Department of Defense to conduct training exercises for the US Army in Europe.
The five-year, $59 million contract to Tapestry Solutions is to design, plan and conduct exercises ranging from Army unit-level activities to large-scale events involving multinational forces, such as the European Commands annual Austere Challenge.
Tapestry, as prime contractor, leads a team that includes SAIC of McLean, Va., and Capstone Corp. and Metro Productions, both of Alexandria, Va.
While the Tapestry team has broad experiences across the training domain, this contract gives us a focused opportunity to demonstrate leadership and continued quality service as we help the (Defense Department) evolve the live, virtual and constructive training domains while addressing todays threats and fiscal realities, said Sam DeFord, Tapestry chief executive officer and president.
The contract calls for the Tapestry team to provide support to the Joint Multinational Simulation Center in Grafenwoehr, Germany, and to its satellites in Kaiserslautern, Germany, and Vicenza, Italy.
Tapestry also will support the Joint Multinational Readiness Center in Hohenfels, Germany, as that center prepares US and multinational brigade combat teams for missions under the US Armys Combat Training Center program.
Tapestry will also supply and coordinate training capability for the Joint Multinational Training Commands Multinational Mission Command Training program as part of US European Commands engagement plan with countries across the European Area of Operational Responsibility.

John Gelsimino usually flies radio-controlled helicopters in the Lake Geauga Helicopters Association.
However, the Lyndhurst resident said he was impressed Friday when he saw the real thing up close at Notre Dame College of Ohio.
Two UH-60 Black Hawk Helicopters floated in the air and then landed on a grassy area by the administration building of the South Euclid college. They had arrived to transport 42 ROTC Cadets.
The future officers along with 23 other cadets by bus were travelling to the Ohio Army National Guards Camp Ravenna Joint Military Training Center for in-field training exercises this weekend.
Every semester, the cadets from Notre Dame College, John Carroll University, Case Western Reserve University, Cleveland State University, and Hiram College attend training at the camp.
However, this was the first time they traveled by helicopter.
In fact, US Army Capt. Matt McGraw said they havent done this in about 20 years and the cadets are getting a rare opportunity.
We are doing a very realistic and relevant training for the cadets, he said. We dont normally get to do any preparation or planning for air movement. What I hope (the cadets) get out of it is the realism of the training that our Army soldiers and officers are applying overseas right now.
Army officials noted, it was a specially modified stealth version of the Black Hawk that transported the elite Navy SEALs team on the top-secret mission that resulted in the death of Osama bin Laden.
Despite the heavy rains, many spectators came, as some stood on the campus rooftops to watch the helicopters arrive on Friday morning. Continued…

Tampa DUI attorney Stephen Higgins, in three separate DUI cases this week, negotiated with the State Attorney to amend all three charges to reckless driving.
In the first case, Higgins’ client was stopped for speeding. According to the arresting officer, the defendant performed poorly on field sobriety exercises, was arrested and provided a breath sample barely over the legal limit. Attorney Higgins negotiated with the State Attorney, who, on the verge of trial, amended the charge to reckless driving.
Higgins’ second case involved a client stopped for weaving and failure to maintain a single lane. The defendant consented to field sobriety exercises and was arrested. Because he had a prior offense within the past five years, he refused to provide a breath sample. Upon review of the video, Attorney Higgins negotiated with the State Attorney to amend the charge to a reckless driving, preventing his client from (1) serving mandatory county jail time and (2) losing his driving privileges for five years.
The third client of Attorney Higgins was reportedly observed by police officers driving erratically and making a wide left turn into a parking space. On video, the defendant stumbled when exiting the car but performed well on the field sobriety exercises. She later refused to provide a breath sample. On the day of trial, Higgins was able to have the charge amended to reckless driving – and the defendant was ultimately not convicted.

I love Halloween. As kids we anticipated the night wed canvas the neighborhood in plastic costumes, visiting house after house. Especially that one crazy lady who dressed as a witch and tried her best to scare us.

Take a photo of your costumed children and then add a postcard theme, creepy effects, titles and more. Finally, share it with far-flung family and friends via email, Facebook and more.

The air is getting cooler, the days getting shorter (here in the northern hemisphere at least) and the time is right to curl up with a good, scary book. Of course, we suggest doing so with your iPhone, iPod touch or iPad. Here are a few Halloween suggestions.
The Masque of the Red Death ($0.99) This digital interpretation of Edgar Allen Poes classic tale is rather unique. As you read, a soundtrack creates an effective mood. Its more than music, though. Actions described in the text can be heard in the soundtrack: doors slam, maidens scream, chandeliers crash to the stone floor. As you read, the app notices your pace and times these sounds to almost the very moment you read the corresponding words. Its uncannily accurate and a lot of fun.
Incidentally, the Vincent Price movie is also quite good.
Dracula: The Official Stoker Family Edition ($4.99) Heres another enhanced book app. This title goes beyond a soundtrack by offering lots of fun stuff to do. As you read, youll swing a lantern to reveal text, open letters tucked inside envelopes and blow the leaves off of a tombstone. Youll also find vintage photographs from the Dracula legacy, some released for the first time with this app. Its an unusual reading experience — more of a game than a book — and a lot of fun. Plus, its got the full blessing of the official Stoker Family Estate.
Mickeys Spooky Night Puzzle Book ($0.99) Heres one for the kids. Mickeys Spooky Night Puzzle Book from Disney offers a cute tale plus a few fun activities. Read the story and then complete the various puzzles. You can even record your own voice, turing the app into a personal read-along.

Forget bobbing for Apples, weve got A5 chips! Here are a few picks for iOS gaming, both light-hearted and hardcore.
Plants Vs. Zombies HD ($6.99, $2.99 for Plants Vs. Zombies for iPhone) Itd be impossible not to mention this smash hit from PopCap Games. Its a tower defense game with an undead theme. Youre job is to stop the invading horde from entering your house by hurling all matter of plants at them. It sounds crazy and it is. Crazy fun!
Dark Meadow ($5.99, universal) Built on the Unreal Engine, Dark Meadow is serious fun with serious graphics. Part first-person-shooter and part puzzle game, your job is to unravel the mystery of the abandoned mental hospital, battle baddies and eventually escape. Theres a lot of story here, nice battle mechanics and good looks.
Monster Dash ($0.99, universal) This platform shooter has you blasting away all sorts of bad guys across various worlds, from back alleys to ancient Egypt and icy tundras. Grab yourself a jet pack for high-flyng fun.
There you have it, a dozen apps to enhance All Hallows Eve. Have fun, and dont eat your candy all at once.
